Pharmaceutical and Medical Device Litigation

Topamax (topiramate):

The FDA has warned that Topamax (Topiramate), a drug used during pregnancy, has been linked to oral birth defects, including:

  • Cleft lip (cheiloschisis) – Symptoms of cleft lip present as a small gap at the top of the lip or an indentation of the lip. Cleft lip can also continue into one nostril (unilateral complete) or both (bilateral complete).
  • Cleft palate (palatoschisis) – A condition where the roof of the mouth (soft and hard palate) is not fully formed. A complete cleft palate can affect the soft and hard areas from uvula to the nasal cavity, and many times includes a cleft lip. It may also be limited to a hole in the roof of the mouth, which is referred to as an incomplete cleft palate.
  • Hypospadias – Usually a male birth defect wherein the urethral opening appears on the underside shaft of the penis rather than the tip.

Other potential problems may exist during eating and talking, and may include ear infections. Topamax is used to treat epilepsy, mood disorders and chronic pain. It has also been prescribed to prevent migraines.

Diflucan (fluconazole):

The FDA has warned that long-term, high doses of Diflucan may be associated with a  birth defects in infants whose mothers were treated with the drug during pregnancy.  Diflucan is an antifungal medication, generically known as Fluconazole. Diflucan is manufactured by Pfizer Inc., and it is also sold as Trican.  It is used to treat a number of fungal infections such as Candidiasis, tinea corporis, tinea cruris, tinea pedis, crypotcoccal meningitis, and onychomycosis. It is also used as a first-line for the following indications: coccidiodomycosis, crytococcosis, histoplasmosis, and prophylaxis of candidiasis. The following kinds of birth defects have been reported by mothers who have had children with Diflucan birth defects: 

  • Joint deformities
  • Long Bones
  • Thin Ribs
  • Craniosynostosis
  • Congenital Heart Disease
  • Bowed Thigh Bones
  • Abnormal head shape

Xarelto (rivaroxaban) is a new blood-thinning drug that has been linked to hundreds of injuries and deaths since it was approved in 2011. It is used to treat blood clots, deep vein thrombosis (DVT), and pulmonary embolisms. Xarelto has no effective reversal agent. In a traumatic accident or during a cerebral hemorrhage (bleeding in the brain), doctors may struggle to stop bleeding in a patient on Xarelto. Some studies have also linked Xarelto to a higher risk of bleeding for acutely ill patients.
